Voov Media, LLC (“Voov Media,” “we,” or “us”) knows you care about how information about you is collected, used, shared, and protected. This notice describes our current privacy policy (the “Policy”), which applies to everyone using the Voov Media website and mobile application (collectively, the “Website”). It is essential to understand that by using the Website, you consent to the collection, storage, sharing, and use of your information as described in this Policy. For that reason, it is important that you read this Policy carefully. If you do not accept the terms of this Policy and the referenced documents, do not continue using the Website.

What Personal Information Does Voov Media Gather About You?

Some types of information gathered include:

Information You Provide: We receive and store information you submit through use of our Website or give us in any way. Such information includes, but is not limited to, information you provide when creating your user account, such as your name and username, address, phone number, email address, login and password details, and financial, credit/debit, or other banking information. This includes business information, such as company name, mailing address, telephone number and financial or credit/debit information as well, if any. Other information that you may provide includes, but is not limited to, content you upload, such as videos and their associated metadata, and other material of any kind (“User Generated Content”). The collected information is used to enhance and customize your experience with the Website, to respond to your requests related to the Website, and to communicate with you. You can choose not to provide certain information, but then you might not be able to take full advantage of some of our features. 

Automatic Information: We receive and store information automatically when you interact with us through use of “cookies” and other similar technology. We may also collect and store server logs, including but not limited to, device IP address, access dates and times, features used, other system activity, technical information about your device (e.g. browser type, operating system and basic device information), query activities, and third-party sites or services you were using before interacting with our Website. You may disable cookies at any time. By doing so, the Website will not be able to recognize you as a registered user and will affect your experience.

E-mail Communications: If your computer supports such capabilities, we may receive confirmation when you open any e-mail we send you. If you do not want to receive e-mail from us, please adjust your email preferences or unsubscribe by clicking the unsubscribe link at the bottom of any of our e-mails.

Transaction and Payment Information: We collect transaction details related to your receiving compensation for uploading videos via the Website.

From Your Mobile Device: We receive device and location identifiers when you access the Website using a mobile device. If you permit the Website to access location services through your mobile operating system, we may also collect the precise location of your device when the Website is running in the foreground or background. To the extent provided, we may, with your consent, send SMS messages to your mobile telephone for authentication and security purposes. You may opt out of receiving such messages at any time. You can disable these functions at any time. However, by doing so, the Website may not recognize you as a registered user and will affect your experience.

Information from Other Sources: We may also receive information about you from other sources, including third-party website analytic tools, which collect information about visitor traffic; log file information generated when you access or use the Website, and other metadata and in some instances, geolocation information. We may combine that data with information we have collected.

We do not have a direct relationship with viewers of your videos. Information collected from viewers on other websites or apps are subject to their respective privacy policies.

How Does Voov Media Use and Share This Information?

We may use and share your information (including aggregate and anonymized information) as follows:

Improve User Experience: We may monitor and analyze activity, metrics, and trends, and use your information to verify when you access your account, facilitate payments, create new features or data-related products and service offerings, or to learn how the Website is used; to develop, maintain, and improve your user experience; to understand how you use the Website and to deliver relevant content to you; to streamline the Website by storing your access credentials and log file; and to make suggestions and provide a customized experience via research and development, marketing and advertising; to fix technical errors, update the Website, and other internal operations; and to communicate with you.

Third Party Service Providers: We may employ other companies (including affiliates within our network) to perform functions on our behalf. These service providers and affiliate companies have access to personal and business information needed to perform their functions but are not authorized to use it for other purposes. We do not provide any of your non-public information (such as payment information, password details, or your IP address) to third parties without your consent, unless required by law.

Protection of Voov Media and Others: We will use collected information to enhance the safety and security of the Website and our other users. In addition, we reserve the right to disclose information and any User Generated Content when we believe that doing so is reasonably necessary to comply with the law or law enforcement, to prevent fraud or abuse, to detect content that violates our Terms and Conditions, or to protect Voov Media’s rights. For example, we may need to gather your data to respond to a subpoena or court order.

In a Merger or Sale: Your information may be shared as a company asset in the event of a potential sale, merger, acquisition, or other change of ownership or control of Voov Media, whether in part or whole.

How Does Voov Media Protect Your Information and How Can You Help?

Voov Media works to protect your information during transmission by using Secure Sockets Layer (“SSL”) software, which encrypts information you input. SSL is used to prevent unauthorized access, maintain data accuracy, and to ensure the correct usage of information. We also use other physical and organizational security measures to safeguard your data from accidental or unauthorized disclosure.

You agree that information you provide may be seen by others and used by us as described in this Privacy Policy and our Terms and Conditions (as they may change from time to time) which are hereby incorporated by reference in their entirety. Keep in mind that videos uploaded by you may be shared and posted on other websites and social media platforms. We will never ask for your username and password, and you should not share such information with others. We encourage you to use a unique and hard-to-guess password for your account and to not share it with others. You should only grant access rights to people who you know and trust, and, even then, you should be careful in granting all access rights. You should monitor your account regularly. Remember to sign off after using any shared computer. If you believe someone has gained access to your account without your permission, contact us immediately so that we can investigate.

What Choices Do You Have?

You may access a range of information about your user account through the Website. You may update your information or deactivate and delete your account at any time as further detailed in the Terms and Conditions and your Media Content License Agreement (if any). You have the right to opt-out of non-essential cookies, access, correct, delete, restrict, or object to use of your personal information, port your data and withdraw consents, in accordance with national and international privacy laws. Voov Media may, in its sole discretion, comply with your requests regarding access, correction, and/or deletion of personal data it stores in accordance with applicable law. However, we may not be able to comply with requests to the extent that they would cause us to violate any law or infringe any other person’s rights.

Are Children Allowed to Use the Website?

Use of the Website is intended for people 18 years of age and over. Users under the age of 18 may not use the Website. We do not knowingly collect, share, or store information from users under 18 years of age.

Conditions of Use, Notices, and Modifications

If you choose to use the Website, your visit, use, or any dispute over privacy is subject to this Privacy Policy, our Terms and Conditions, and your Media Content License Agreement (if any) including limitations on damages, resolution of disputes, and application of the law of the State of Florida.

Voov Media reserves the right to change the Website and the terms of this Policy at any time. If modifications are made, we will provide you notice of such modifications and when they go into effect. It is your responsibility to review these notices and any modifications to this Policy. If you use (or continue to use) the Website after a change, that means you accept the new Policy terms. We encourage you to review this page periodically for the latest information on our privacy practices. The date of last revision is shown at the top of this Privacy Policy.

Voov Media may be required to disclose personal data in response to lawful requests by public authorities, including disclosures necessary to meet national security or law enforcement requirements, or pursuant to judicial orders.

International Data Transfer, California Privacy Policy, and Certain User Rights

Voov Media is in the United States and provides services globally using computer systems in the United States and in other countries. If you are outside the United States and you use our services, your information may be transferred to and processed in the United States.

GDPR and Privacy Shield (European Economic Area (EEA), UK, and Swiss Users)

It is Voov Media’s policy to comply with European Union’s General Data Protection Regulation (“GDPR”). In accordance with the GDPR, we may transfer your personal information from your home country to the United States or other countries if there are legitimate business interests if we cannot provide our services or comply with our legal obligations without transferring your personal information to the U.S., via other compliance mechanisms and for use of the European Union Standard Contractual Clauses, and for our certification and adherence to the EU-US and Swiss-US Privacy Shield Frameworks (collectively the “Privacy Shield”). We certify that we adhere to the Privacy Shield Principles of notice, choice, onward transfer, security, data integrity, access and enforcement (“Privacy Shield Principles”) for personal data of Content Creators in participating European countries. We are responsible for the processing of personal data we receive under the Privacy Shield Framework and subsequently transfer to a third-party agent and may be liable for onward transfers in violation of the Privacy Shield Principles. This shall not be the case where Voov Media establishes that it is not responsible for the damage caused by the third party.

If you are a resident of a country participating in the Privacy Shield Framework, you may direct any questions or complaints concerning our Privacy Shield compliance to our Privacy Shield and Data Protection Contact listed below.  We will work with you to resolve your issue.  

Please note that we may not be able to comply with requests to the extent that they would cause us to violate any law or infringe any other person’s rights. We reserve the right to request appropriate identification. We will process any requests in accordance with applicable law and within a reasonable period of time. We will process requests free of charge unless they would impose an unreasonable cost on us.

California Users

California residents have the right to opt out of disclosing information to third parties for the purpose of allowing such third parties to directly market their products and services under California’s “Shine the Light” law. Currently Voov Media does not engage in this type of disclosure.

As a California resident, you may be able to exercise the following rights in relation to the personal information about you that we have collected (subject to certain limitations at law):

Right to Know.  You have the right to request information regarding the categories and specific pieces of personal information we have collected about you as well as information about how we collect, use, disclose, and “sell” personal information.

Right to Request Deletion. You have the right to request the deletion of some or all of the personal information that we have collected from you, subject to certain exceptions. Deleting all data will typically require the deletion of your account, along with all content, including your videos. However, we may retain information to complete transactions, honor opt-outs, prevent fraud, spam, and other abuse, comply with our legal obligations, cooperate with law enforcement, and to exercise and defend our rights.

The Right to Opt Out of Personal Information Sales. You have the right to direct us not to sell personal information we have collected about you to third parties now or in the future.

The Right to Non-Discrimination. You have the right not to receive discriminatory treatment for exercising any of the rights described above.

Please note that in order to exercise your rights to know and delete, we must be able to verify your identity and may not be able to process your request until we do so. Additionally, we may no longer be able to provide you our products or services or engage with you in the same manner should you exercise the right to delete your information.
